These Terms and Conditions ("Terms") govern your use of the Trackwell Australia website [WEBSITE URL] and your participation in any Trackwell events, retreats, newsletter or community activities (together, "Trackwell", "we", "us", "our"). By using our website or booking onto an event, you agree to these Terms. Please read them alongside our Privacy Policy.
1. About Trackwell
Trackwell is a not-for-profit community organisation for four-wheel drivers, campers, hikers and fishers across Australia. We run community events, retreats and communications to bring that community together.
2. Using our website
You may browse and use our website for personal, non-commercial purposes. You must not:
- use the site in any way that breaches any applicable law
- attempt to gain unauthorised access to the site, our systems or any related network
- copy, reproduce, or republish content from the site for commercial purposes without our written permission
- post or transmit anything on our behalf that is unlawful, offensive, defamatory, or infringes anyone else's rights
3. Newsletter and contact enquiries

4. Event and retreat bookings
- Booking: When you book an event or retreat, you're agreeing to pay any listed fee and to provide accurate information (including for safety purposes).
- Payment: Payments are processed securely through our payment provider, NAB. We do not store your full card details.
- Cancellations and refunds: No refunds.
- Changes: We may need to change the details, itinerary or date of an event due to weather, track conditions, or other circumstances outside our control. We'll let you know as soon as reasonably possible if this happens.
5. Assumption of risk — outdoor and 4WD activities
Four-wheel driving, camping, hiking and fishing carry inherent risks, including but not limited to vehicle damage, injury, difficult terrain, weather conditions, and remote or limited-connectivity locations.
By participating in a Trackwell event or retreat, you acknowledge and accept these risks and agree that you take part at your own risk. You're responsible for:
- ensuring your vehicle and equipment are roadworthy and suited to the terrain
- your own and your passengers' safety, and following any safety briefings or instructions given by Trackwell organisers or trip leaders
- holding your own appropriate insurance
To the maximum extent permitted by law, Trackwell, its organisers, volunteers and trip leaders are not liable for any injury, loss or damage arising from your participation in an event, except where that liability cannot be excluded under the Australian Consumer Law or other applicable law.
6. Intellectual property
All content on the Trackwell website — including text, logos, images and design — is owned by or licensed to Trackwell and is protected by copyright. You may not reproduce or use it without our permission, other than sharing via the standard share functions provided on the site.
7. Third-party links and services
Our website may link to third-party websites or use third-party services (for example, our payment provider or Google Analytics). We aren't responsible for the content, policies or practices of those third parties. Please review their own terms and privacy policies.
8. Limitation of liability
To the maximum extent permitted by law, Trackwell excludes all liability for any indirect, incidental or consequential loss arising from your use of the website or participation in any Trackwell activity. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.
